1. Introduction and Acceptance

These Terms and Conditions apply to all driving lessons, gift vouchers and all other services provided by Great Southern Driver Training (GSDT) – ABN 82 287 084 233. By booking a lesson, paying any fee or using our services you agree to these Terms. We may update them from time to time – the current version is always on the website.

2. Services Offered

We provide professional driving instruction in accordance with Western Australian road rules and Department of Transport (DoT) requirements. All instructors are licensed under the Motor Vehicle Drivers Instructors Act 1963 (WA). Lessons are normally conducted in our dual-control training vehicles.

3. Eligibility and Student Responsibilities

You must hold a current valid WA learner’s permit, driver’s licence or equivalent international licence and carry an authorised copy during any and all training sessions. If you do not have your driving permit, the lesson will be cancelled and the full fee will apply.

You must disclose any medical conditions, medications or fitness issues that could affect your driving. You must be ready to go on time, rested and fit to drive. We reserve the right to end the lesson immediately (no refund) if we believe you to be under the influence of drugs or alcohol or if we reasonably deem it to be unsafe. 

You are responsible for your own logbook entries and booking your DoT Practical Driving Assessment (PDA), unless discussed with us (see below). Parents/guardians of students under 18 guarantee payment and consent to these Terms.

4. Use of Your Own Vehicle

If you choose to use your own vehicle for lessons:

• The vehicle must be fully registered, comprehensively insured, and roadworthy.
• You must notify your insurer in writing that a licensed driving instructor will be teaching in the vehicle.
• The instructor has the absolute right to refuse to conduct the lesson if the vehicle is not roadworthy, not clean, or otherwise unsuitable for safe instruction (for example, excessive dirt, rubbish, strong odours, mechanical issues, or anything that could distract or endanger anyone). In this case the lesson fee is still payable or may be rescheduled at our discretion.
• When using your own vehicle you are fully responsible for all insurance, excesses, repairs, damage, fines or claims. GSDT accepts no liability whatsoever.

5. Booking, Payments and Pricing

Lessons must be booked in advance via our website. We accept cash, bank transfer, and major cards (surcharges may apply). Prices are listed on our website and may change at any time (current prices are always shown online). Gift vouchers are non-transferable. DoT Practical Driving Assessment bookings must be completed by you unless otherwise confirmed and arranged with GSDT, whereby we can book on your behalf. We have no control or influence over the availability of DoT test bookings, and cannot guarantee dates/times outside of what is available to everyone.

6. Cancellations, Rescheduling and No-Shows

Please give at least 48 hours’ notice to cancel or reschedule. When lessons are cancelled within this time frame it makes it impossible to allocate that time to other clients.

• Less than 48 hours = Half lesson fee charged
• Less than 24 hours or no-show = full lesson fee charged. 

DoT test cancellations are your responsibility – we are not liable for any DoT fees. 

GSDT reserves the discretion to waive or reduce these fees if we deem it appropriate. 

We aim to be on time for the scheduled appointment, however factors outside of our control may influence this. When we are running late, we will conduct the full scheduled lesson time, running a bit later than scheduled. If this is unsuitable to your time allowance, we may add additional time to your next lesson at no extra cost at our discretion.

7. Refunds and Credits

Refunds are only given in line with Australian Consumer Law. Credits may be issued for genuine rescheduling. Nothing in these Terms limits your rights under the Australian Consumer Law – major failures in service may entitle you to a refund, compensation or other remedy.

8. Lesson Conduct and Instructor Responsibilities

Our instructors will provide safe, professional tuition in a roadworthy dual-control vehicle (when using our vehicles). We reserve the right to end any lesson early for safety reasons, or if the student demonstrates poor behaviour or fails to adequately listen to instructions. Parents/Guardians will be notified immediately if this occurs.

9. Vehicle Damage, Accidents and Liability

When using our training vehicle:

• The vehicle is comprehensively insured for learner use under supervision.
• Our instructors are trained to intervene using dual controls where necessary. You are responsible for the full insurance excess if there is any damage or claim arising from the lesson (including vehicle hire for PDA/test day). The excess depends on the vehicle, as well as the age and experience of the driver – a current schedule of excess fees is available on request.
• You are also responsible for the full cost of repairs if you choose not to make an insurance claim.
• You must report any incident to us immediately.

We hold public liability insurance – details available on request. GSDT is not liable for any indirect loss, personal items left in the vehicle, or delays beyond our control. You indemnify us against any claims arising from your breach of these Terms.

10. Privacy

We collect and handle your personal information (including licence details and medical disclosures) in accordance with our separate Privacy Policy, which is available below. By using our services you consent to this.

11. Intellectual Property

All website content, logos, media and training materials belong to GSDT and may not be re-distributed without our express permission.

12. Changes to Terms

We may update these Terms with notice (usually by posting on www.gsdt.au).

13. Force Majeure

We are not liable for any failure caused by events beyond our reasonable control (e.g. bushfires, floods, road closures common in the Great Southern region).

14. Dispute Resolution

We will try to resolve any issue directly and quickly. These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the WA courts.

15. Entire Agreement and Severability

These Terms (together with our Privacy Policy) form the entire agreement. If any part is invalid, the rest remains enforceable.
