1. Introduction and acceptance

These Terms and Conditions apply to all driving lessons, vehicle hire for Practical Driving Assessments (PDAs), gift vouchers and other services provided by Great Southern Driver Training (GSDT).

By booking a lesson, paying any fee or using our services, you agree to these Terms. We may update them from time to time. The current version is always on the website.

2. Services

We provide professional driving instruction in accordance with Western Australian road rules and Department of Transport (DoT) requirements. Instructors are licensed under the Motor Vehicle Drivers Instructors Act 1963 (WA). Lessons are normally conducted in our dual-control training vehicles.

3. Eligibility, communication, health, conduct and student responsibilities

You must:

• Hold a current valid WA learner’s permit, driver’s licence or equivalent international licence, and carry it during every session. If you do not have your permit with you, the lesson will be cancelled and the full fee applies.
• Be able to speak, read, understand and respond to instructions in English without translation apps, devices or interpreters. This is a safety requirement. We do not provide translation services. If we cannot communicate effectively in English, the lesson will be cancelled or refused and the full fee applies.
• Disclose any medical condition, medication or fitness issue that could affect your driving.
• Be ready to start on time, rested and fit to drive.
• Contact us before the lesson if you are sick, unwell or otherwise unfit to drive (including anything that may put the instructor or other students at risk of infection in a shared vehicle). We may refuse the lesson if you present as unwell. With reasonable prior notice, we may at our discretion credit or refund part of the fee.
• Listen to instructions, follow directions promptly and safely, and behave respectfully.

We may end a lesson immediately (no refund) if we believe you are under the influence of drugs or alcohol, you are unfit to drive, effective communication in English is not possible, or we reasonably consider it unsafe because of behaviour, failure to follow instructions, or any other reason. Parents or guardians will be notified if a lesson is ended early for these reasons.

You are responsible for your own logbook entries and for booking your DoT PDA, unless we have agreed in writing to arrange it.

Parents or guardians of students under 18 guarantee payment and consent to these Terms.

4. Bookings, payments and pricing

Lessons must be booked in advance. Bookings must be in the name of the student driver, not the person making the booking. Parent or guardian details are added on the booking form.

All bookings require payment as directed at the time of booking. We accept cash (payable on arrival, by prior arrangement), bank transfer, and major cards. 

Customers paying cash must contact us before booking. An online confirmation at $0 is only to hold the time; the lesson fee is still payable in cash on arrival.

Prices are listed on the website and may change at any time. Current prices are always those shown online.

Gift vouchers are non-transferable.

All pricing, discounts and special arrangements are at our discretion. A discount given to one customer does not create a right or expectation for anyone else.

DoT PDA bookings are your responsibility unless we have confirmed in writing that we will arrange them.

We have no control over DoT staffing, when DoT releases PDA dates, or DoT changing or cancelling an existing PDA at short notice. Booking a lesson does not lock that time forever if the diary has to move so a student can sit a test. See clause 5.

5. Changes to lesson times by GSDT

GSDT may change or request to the date or time of a booked lesson where reasonably necessary, including to:

• get a student to a PDA when DoT releases a date, or moves or cancels an existing PDA;
• deal with DoT staffing shortages or late publication of PDA dates;
• deal with instructor illness or unavailability, vehicle unavailability, weather, road closures, or other operational reasons.

We will give as much notice as reasonably possible using the phone, text or email on the booking.

A change made by us under this clause is not a customer cancellation or reschedule under clause 6. The lesson fee stays with the booking. You are not charged extra just because we moved the lesson.

If the new time does not work, contact us promptly. We will offer another time. If we cannot agree a new time within a reasonable period, we may provide a credit or a refund of the unused lesson fee.

The same flexibility is what gets you to the test when it is your turn.

Nothing in this clause limits your rights under the Australian Consumer Law.

6. Cancellations, rescheduling, no-shows, credits and refunds

This clause applies when you cancel or reschedule.

At least 48 hours’ notice is required.

• Less than 48 hours: half the lesson fee is charged.
• Less than 24 hours, or a no-show: the full lesson fee is charged.

DoT test cancellations and any DoT fees are your responsibility.

If you are sick or unfit to drive, you must contact us before the lesson. With reasonable notice we may, at our discretion, waive or reduce the fee or give a partial credit.

We aim to arrive on time. If we are running late we will still deliver the full lesson time. If that does not suit you, we may add time to a later lesson at our discretion.

Refunds are only given in accordance with the Australian Consumer Law. Nothing in these Terms limits your rights under that law.

7. Use of our training vehicles

When using our training vehicle:

• The vehicle is comprehensively insured for learner use under supervision.
• You are responsible for the full insurance excess if there is any damage or claim arising from the lesson (including vehicle hire on PDA / test day). A current schedule of excesses is available on request.
• You are also responsible for the full cost of repairs if you choose not to claim on insurance.
• You must report any incident to us immediately.

We hold public liability insurance. GSDT is not liable for indirect loss, personal items left in the vehicle, or delays beyond our control. You indemnify us against claims arising from your breach of these Terms.

8. Use of your own vehicle

If you use your own vehicle for lessons:

• It must be fully registered, comprehensively insured and roadworthy.
• You must notify your insurer in writing that a licensed driving instructor will be teaching in the vehicle.
• The instructor may refuse the lesson if the vehicle is not roadworthy, not clean, or otherwise unsuitable. The fee remains payable, or the lesson may be rescheduled at our discretion.
• You are fully responsible for insurance, excesses, repairs, damage, fines and claims. GSDT accepts no liability.

9. Instructor responsibilities

Instructors will provide safe, professional tuition in accordance with Western Australian road rules. In our dual-control vehicles, instructors are trained to intervene using the dual controls where necessary. We aim for a supportive lesson while always putting safety first.

10. Privacy

We collect and handle personal information in accordance with our Privacy Policy on the website. By using our services you consent to that handling.

11. Intellectual property

Website content, logos, media and training materials belong to GSDT and must not be reproduced without our written permission.

12. Changes to these Terms

We may update these Terms by posting the current version on gsdt.au. The version on the website at the time of your booking applies to that booking, unless a change is required by law.

13. Events outside our control

We are not liable for failure or delay caused by events beyond our reasonable control, including bushfire, flood, road closure, vehicle breakdown, instructor illness, and DoT systems or staffing issues. Where we can, we will reschedule under clause 5 rather than cancel.

14. Dispute resolution

We will try to sort any issue directly and promptly. These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of the WA courts.

15. Entire agreement and severability

These Terms and our Privacy Policy are the entire agreement. If any part is invalid, the rest still applies.
